17:00 – 19:00 Session on Competition Law and Consumer Protection: A Unified Field?
The session will cover the interaction between competition law and unfair competition law, the role of behavioural law and economics and libertarian paternalism in enhancing the role of consumer protection agencies (e.g. confusopoly situations), jurisdictional issues: how is it possible to take into account competition concerns in consumer protection law and how strong are consumer protection objectives in competition law enforcement, the role of class actions in consumer protection and competition law: a comparative appraisal

This session will discuss recent advances in the economics of information exchange agreements. The impact of behavioral law and economics on information exchange will be particularly analyzed as well as implications for competition policy in general.

The session will analyze the enforcement of competition law in the EU and some major jurisdictions concerning information exchange. Issues to be discussed in more detail from a compliance perspective would include:

o Chinese walls in general
o Trade associations: how not to be caught by EC competition law
o Category management and the risk of collusion
o Information exchange in mergers

14:15 – 16:00 The Future of Information Exchange in Competition Law
This session will include a roundtable discussion on a retrospective and prospective of the enforcement of competition law to information exchange between competitors in the EU and several Member States. Part of the discussion will delve into the principles of the forthcoming EU Commission’s guidelines on horizontal cooperation agreements, which include a section on information exchange and some recent decisional practice in some Member States (in particular the UK and France).
